Terms of Service

1. Acceptance of Terms
By accessing or using the Cineq mobile application (iOS and Android) and the website at cineq.app (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance.
2. Eligibility
You must be at least 13 years old (or 16 in the EEA) to use the Service. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Your Account
You are responsible for maintaining the security of your account credentials. You must not share your account or allow others to access it. You are responsible for all activity under your account.
You may authenticate via Apple Sign In or Google Sign In. We rely on these providers for identity verification and do not store your passwords.
4. The Service
Cineq is a social film and TV tracking platform. The Service allows you to:
- Log films and TV shows you have watched, with ratings, reviews, tags, and theatre information
- Maintain a watchlist and curate custom lists
- View personal statistics and insights about your viewing habits
- Follow other users and participate in a social feed
- React to and comment on other users' logs and reviews
- Participate in Watch Party sessions
- Discover new content through taste-based recommendations
- Import watch history from third-party services (e.g., Letterboxd)
5. Cineq Premium
Cineq offers an optional paid subscription ("Cineq Premium") that unlocks additional features. Basic features including personal statistics are always free.
5.1 Billing
Premium subscriptions are billed through:
- Mobile: Apple App Store (iOS) or Google Play Store (Android), managed via RevenueCat
- Web: Stripe payment processing
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. Prices are displayed in your local currency at checkout.
5.2 Cancellation & Refunds
You may cancel your subscription at any time. Upon cancellation, you retain Premium access until the end of your current billing period. Refunds for mobile purchases are handled by Apple or Google per their respective refund policies. For web purchases via Stripe, contact us at support@cineq.app within 14 days of purchase for a refund.
5.3 Price Changes
We may change Premium pricing with at least 30 days' notice. Existing subscribers will be notified before their next renewal at the new price.
6. User Content
6.1 Your Content
You retain ownership of the content you create on Cineq (reviews, ratings, lists, comments, profile information). By posting content, you grant Cineq a worldwide, non-exclusive, royalty-free license to display, distribute, and promote your content within the Service and in marketing materials for the Service.
6.2 Content Guidelines
You agree not to post content that:
- Is illegal, hateful, threatening, harassing, defamatory, or discriminatory
- Contains spam, malware, or phishing attempts
- Infringes on intellectual property rights of others
- Contains personally identifiable information about others without consent
- Is sexually explicit or depicts violence gratuitously
- Impersonates another person or entity
- Manipulates ratings, reviews, or engagement metrics artificially
6.3 Content Moderation
We reserve the right to remove any content that violates these Terms, without prior notice. Repeated violations may result in account suspension or termination.
7. Third-Party Content & Data
Film and TV metadata, posters, cast information, and related media are sourced from TMDB (The Movie Database). This product uses the TMDB API but is not endorsed or certified by TMDB. Theatre venue information is sourced from the Google Places API. Streaming availability data is sourced from third-party providers.
We do not guarantee the accuracy, completeness, or timeliness of third-party data displayed in the Service.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to access other users' accounts or private data
- Scrape, crawl, or use automated tools to extract data from the Service
- Reverse-engineer, decompile, or disassemble any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Create multiple accounts to circumvent restrictions or bans
- Use the Service to send unsolicited messages or spam
- Exploit bugs or vulnerabilities instead of reporting them
9. Intellectual Property
The Cineq name, logo, visual design, and all original software code are the property of Cineq and are protected by intellectual property laws. You may not use our trademarks or branding without prior written permission.
10. Account Termination
You may delete your account at any time from the Settings page. We may suspend or terminate your account if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Data deletion follows our Privacy Policy.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CINEQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify and hold harmless Cineq and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your content, or your violation of these Terms.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Orange County, Florida.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
